                   (א) להקטין את שיעור תמותת התינוקות לשם קידום בריאות הילדים במדינה;
                   (ב) לשפר את כל ההיבטים הקשורים בהיגיינה סביבתית ותעשייתית;  
                   (ג) למנוע, לטפל ולשלוט בתפוצת מחלות מסוגים שונים;
                   (ד) יצירת תנאים המוודאים את קיומם של שירותים רפואיים לכל סוגי הבעיות הרפואיות.
 
              ב. סעיף 12(3) - על המדינות לאפשר גישה לכל בעלי המוגבלויות לקבלת תמיכה לשם מימוש יכולותיהם השכליות והמשפטיות.
 
            2.        CESCR, General comment no. 14
                סעיף 12 - על המדינה לקדם בדרכים שונות את יכולתם של אנשים ונשים להסכים באופן מודע לטיפולים רפואיים. המדינות יעשו זאת תוך אימוץ תפיסות המקדמות זמינות, נגישות, הכלה ואיכות של המידע                                             הרפואי הניתן  למטופלים
 
     ג.        פונדקאות 
                1.       ECHR – ביהמ"ש האירופאי לזכויות אדם                                                                                                                                                                                                                                                        Mennesoon v. France (26/4/2014); Labassee v. France (26/6/2014) –  בשני המקרים צרפת סירבה להכיר בהליך פונדקאות שנעשה בארה"ב. ביהמ"ש קבע כי בעוד שהזכות לחיי משפחה                                             (המעוגנת בסעיף 8 לאמנה האירופאית לזכויות אדם) אינה נפגעת עקב מדיניותה של צרפת, הזכות לפרטיות, המוגנת גם היא בסעיף זה) אכן נפגעת ועל כן החלטתה של צרפת נפסלת.  
 
2.       קרובי משפחה - משפחה גרעינית במקרי מוות או מחלת נפש
        א.        Human Rights Committee, General comment No. 28, para. 28
                  כחלק מחובותיה של המשפחה הקרובה יש לכלול גם את החובה להתנהג בשוויון כלפי בני ובנות המשפחה בכל הנוגע לחינוך, טיפול רפואי ועוד.
        ב.      Committee on the Rights of the Child, General comment No. 7, para. 15.
